Terms of Service

1. Acceptance of Terms

By downloading, installing, or using HTReminder ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and JB-AI Productions ("Company," "we," "us," or "our").

If you do not agree to these Terms, do not use the App.

2. Description of Service

HTReminder is a mobile application designed to help hot tub owners track maintenance schedules, chemical levels, and receive AI-powered analysis of water test strips. The App is intended as a helpful tool and does not replace professional pool and spa maintenance advice.

3. Age Requirements

You must be at least 18 years of age to create an account and use this App.

By using the App, you represent and warrant that you are at least 18 years old. If we discover that a user is under 18, we will terminate their account immediately.

This App is not intended for children under 13, and we do not knowingly collect personal information from children under 13 in compliance with COPPA.

4. User Responsibilities

You agree to:

• Provide accurate information when creating your account
• Maintain the security of your account credentials
• Use the App in compliance with all applicable laws
• Follow manufacturer guidelines for your hot tub equipment
• Handle pool and spa chemicals safely and responsibly
• Verify AI-generated recommendations before acting on them
• Not rely solely on the App for safety-critical decisions

5. AI-Powered Features and Disclaimers

You acknowledge and agree that:

• AI analysis may not be 100% accurate and should be verified
• AI recommendations do not constitute professional advice
• You are responsible for verifying all chemical readings with manual testing
• The Company is not liable for any damages resulting from reliance on AI features
• AI features require an active subscription and internet connection
• Photos submitted for AI analysis are processed by Google's Gemini AI service

6. Subscriptions and Payments

6.1 Subscription Tiers

HTReminder offers the following subscription options:

• Free: Basic maintenance tracking without AI features
• Consumer: AI scanning features with monthly limits
• Professional Basic: Enhanced limits and customer management
• Professional Plus: Maximum features and priority support

6.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store, as applicable to your device. All billing is handled by Apple or Google according to their respective terms.

6.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription rate.

6.4 Cancellation

You may cancel your subscription at any time through:

• iOS: Settings → Apple ID → Subscriptions → HTReminder → Cancel
• Android: Google Play Store → Menu → Subscriptions → HTReminder → Cancel

Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.

6.5 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

7. Data Collection and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key points:

• We collect account information, hot tub data, and usage analytics
• Photos submitted for AI analysis are processed but not stored on our servers
• We use Firebase (Google) for authentication and data storage
• We use Google Gemini AI for image analysis features
• We do not sell your personal information to third parties

8. Intellectual Property

The App, including its design, features, code, and content, is owned by JB-AI Productions and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App's name or branding without permission
• Remove any copyright or proprietary notices

9. Limitation of Liability

To the maximum extent permitted by law:

• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any damages arising from your use of the App, including but not limited to property damage, personal injury, or chemical-related incidents
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

You assume all responsibility for safely operating your hot tub and handling chemicals.

10. Indemnification

You agree to indemnify and hold harmless JB-AI Productions, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Dispute Resolution

11.1 Arbitration Agreement

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

11.2 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

11.3 Small Claims Exception

Either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

11.4 Opt-Out

You may opt out of the arbitration agreement by sending written notice to [email protected] within 30 days of first using the App.

12. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the App or its features
• Are under 18 years of age

You may delete your account at any time through the App settings or by contacting us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of such courts.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JB-AI Productions regarding the App.
